This time we have partnered with Michigan Citizens for Election Integrity (MC4EI.com) for organizational support. Ground rules 1. The most important rule is to follow Michigan election law to the letter. 2. The law allows elections and the electoral process to be observed. The election starts as soon as the first absent voter ballots are mailed out. These ballots will be returned to clerk's offices, satellite voting centers and via deposition in drop boxes throughout the State of Michigan. Organized observation of activities in these public areas is permittedas long as the observer never threatens or intimidates a voter or election staff. Unlike election challengers, poll watchers do not have to be registered as a voter. Only candidates for elected office in the election are barred from serving as a poll watcher in that election. 3. Always respect voters' privacy and autonomy. Know that the vast majority of people dropping ballots into the drop boxes are eligible voters exercising their Constitutional rights and doing it fully within the law. The best-case scenario is for us to see nothing but law-abiding voterswhere ever we observe. 4. The role of the Drop Box Observer is to establish enough of a presence that would-be law breakers are effectivelydeterred from committing violations of Michigan laws against ballot box stuffing and ballot harvesting and relatedcriminal activity. 5. Remember, these are guidelines only and the final authority governing all your Drop Box Observer activities is Michigan Election Law. Carefully read the sections governing poll watchers of the below official document prior to starting your role as drop box observer: "The Appointment, Rights, and Duties of Election Challengers and Poll Watchers" https://www.michigan.gov/-/media/Project/Websites/sos/01vanderroest/SOS_ED_2_CHALLENGERS.pdf?rev=96200bfb95184c9b91d5b1779d08cb1b 6. There is no money involved and all observation is conducted on a strictly voluntary basis. 7. Any failure to abide by these rules will result in the Drop Box Observer/ ballot tracker being dismissed immediately from any further association with this voluntary initiative. How does ballot tracking work? Ballot trackers can observe in a variety of ways, as long as they do not impede, interfere with or intimidate voters in any way. They can stand in the vicinity of the drop box, but they should never position themselves in front of it. They can observe from a vehicle or building and take photographs and videos of suspicious activities but are cautioned to do this in a way that is not intrusive to the voter. If any questionable or even blatantly illegal activity is observed, the ballot tracker should NOT confront the voter! Rather, contact our legal hotline for advice on how to proceed and specifically on whether to contact law enforcement. Remember that some activities that appear to be improper may, in fact, be fully legal under Michigan law. An example is the person who deposits 3 ballots into a drop box. This may appear to be ballot harvesting, but it may be fully legal IF the person is assisting another voter and meets any of the following requirements. The person depositing a ballot for another must: • be a member of the immediate family of the voter being assisted (includes in-laws) • live in the same household • be a postal or election worker in the performance of their duties When a ballot tracker is observing inside a satellite voting center or clerk's office they must avoid conversing with or interacting with them in any way and they should talk only to the supervisor of that facility or their designated representative. If asked by election staff why they are there, it's okay to say "I'm observing the election process." The clerk's offices and their satellite voting centers will begin to accept absentee ballots returned after mailing several weeks prior to Election Day. The activities in these facilities include voter registration, Absent Voter (AV) ballot pick up and return. Often the voter will obtain, vote and submit his ballot during the same visit. Potential violations of election law: Violation of voter secrecy. This is where a ballot is issued to a voter inside a clerks' office or satellite and, after it is voted and returned to the poll worker, the worker views the voted ballot. This was witnessed by our ballot trackers in the 2020 election. Theft of ballots. There are many ballots inside these centers and they are often lying openly in trays or on desk tops. Pay particular attention to BLANK ballots, which were identified in 2020 laying openly and unattended in large stacks inside satellite centers. Ballot harvesting Gathering up ballots from voters and submitting them to be counted is ILLEGAL in Michigan, with the above-noted exceptions. Ballot trackers should be alert to the possibility of such activity taking place both inside and outside of satellite voting centers. This was observed by our ballot trackers in 2020. Ballot stuffing Then end game of a subset of ballot harvesting occurs when the illegally-harvested ballots are inserted into a drop box, which affords the harvester reduced risk of detection, since he or she does not have to interact with election staff or answer questions regarding the number of ballots being deposited. In most areas, the drop box will be under video camera surveillance, however this is typically not done in real time and often the footage will never by viewed by law enforcement. |
