SCOTUS on LGBT Appeals Court Rulings ~ Not Federal purview to judge. why no dismissals at Appeals level? #MIGOP #tcot #sgp

Federal law does not supersede State law when Federal law/Court Rulings are unconstitutional.

 In the SCOTUS recent Windsor decision of not hearing the several Appeals Court decisions, the Federal Supreme Court stated that they are not hearing those cases, because the federal government has no jurisdiction over moral issues.  This should of it's own undone those Appeals courts that removed the States' Sanctity of Marriage determinations of marriage being of one man and one woman.

Why have we been silent to this fact?  Why have not these Appeals Court decisions been dismissed?


On Tuesday, United States District Judge Juan Pérez-Giménezupheld Puerto Rico’s law defining marriage as the union of a man and a woman. He concluded that the U.S. Constitution does not require the redefinition of marriage.
And it is the Supreme Court’s Windsor decision that Pérez-Giménez highlights as to why states have constitutional authority to make marriage policy:
The Windsor opinion did not create a fundamental right to same gender marriage nor did it establish that state opposite-gender marriage regulations are amenable to federal constitutional challenges. If anything, Windsorstands for the opposite proposition: it reaffirms the States’ authority over marriage, buttressing Baker’s conclusion that marriage is simply not a federal question.
Pérez-Giménez goes on to cite Windsor: “the definition of marriage is the foundation of the State’s broader authority to regulate the subject of domestic relations with respect to the ‘protection of offspring, property interests, and the enforcement of marital responsibilities.’”

Has anyone looked into this plan? The claims are better then FairTax, but there is something that just don't sit right. What would control the Feds and how would States be free of Federal domination? How can such a taxation bring in so much revenue and be so small to the average citizen? It is scary on the surface as it sounds so promising.
Learn how we calculate the Transaction Tax based on total US transactions. And how taxes would be instantly collected and wired to the US Treasury over our electronic banking network.

The claim is $.35 per hundred of transaction.

The IRS Tax Code presently puts embedded taxes in American product and service. By this billing, the individual or business would have to increase the price of their product and service the amount of the tax 
expense on service provided. 

With the current system, business pay a 35% income tax(unless they bribed congress) and you know what families pay. The average embedding of tax is about 22% of product price and 29% of service price. 

The only tax that would make the USA be able to compete with imports and tax their consumption equally as with a sales tax.

Now I see this transaction tax, a consumption of transaction concept and see they may be on to something. It took 6 months for FairTax to reach Eureka.

I asked some friends at FaceBook 'FairTax 2012' Group what they thought of this Transaction tax::

EVERY transaction is taxed, so the level of taxes can be large when products pass through several, if not many middlemen.

Tony Leach~  Glenn is right, any tax on transactions will be passed down as a cost of doing business so it's a VAT on transactions. Either way the people still pay it and it's hidden once again. All these other plans do the same thing but still have taxes being passed on. Why bother if we can just push them all to the end of the line and free up the economy from taxes 100%?

Gridlock by not electing Governor Snyder may just work #MIGOP #MIGOV #rightmi #migrassroots

Its pretty bad when our BEST alternative comes from tying the hands of our lawmakers so that they might accomplish none of their goals. Its bad when either gubernatorial candidate represents a regressive or potentially dangerous path for our state. Its uncomfortable to have to advocate such a position, but Ballenger, and Melinn get it.
Look, its not as if we didn’t warn of the poison infecting the Republican party before. Mark Schauer is BAD NEWS. But Rick Snyder, beyond whatever reasonable reforms already made, has his own plans that we will not, and can not support any more than the Democrat’s own.
If Snyder loses, (which appears to be less probable the more folks see Schauer) it must be seen as a clear repudiation by conservatives, and a loss of the base. Don’t think the flags wouldn’t be raised for broader support of the Schauer (leftist) doctrine. As we have seen already, the Romney loss and subsequent misplaced blame was a severe example of denial by party leadership.
As you can see from the article below, Governor Snyder will be doing this.  Here is a very good statement on the subject of Marriage:

Rock bottom principle: marriage is a civil institution because government thereby secures essential rights, the rights of fathers to their families. Take away marriage laws, and fathers have no enforceable rights. Mothers can take the kids, kick out the Dad, deny access, with no legal recourse. With marriage laws, families are secure. Without them, society is survival of the fittest.

On Thursdays, Facebook fans have adopted a growing ritual affectionately known as "Throw Back Thursday." Users post their favorite remembrances from the past – a childhood picture, a tattered piece of high school memorabilia, news clippings of a place where the locals once gathered.

For Facebook, taking a walk down memory lane has proven to be a popular activity for many users. For the FairTax® campaign, taking time to look at the past provides a possible window into understanding the journey that has gone before us and lies ahead.

The FairTax legislation, first introduced in Congress 15 years ago, represents the greatest transfer of power from the Congress to the people since the Founding Fathers began drafting the Constitution in 1787. Some people say they love the FairTax but don't think it will ever become law. Others believe that we have to repeal the 16th Amendment, and because repealing an amendment takes a long time, there is no reason to push the FairTax now.

It is important that doubters consider these historical facts:

  • While the 13th Amendment, which abolished slavery, may have taken less than a year to be ratified, the decades leading up to its passage divided the nation and engulfed it in a bitter and costly civil war, but its supporters persisted and it was enacted.
  • The 27th Amendment, which prohibited increasing or decreasing the salary of Members of Congress until the next term of office begins for the House of Representatives, was introduced in 1798 and even though it took 202 years, 7 months and 12 days to ratify, its supporters persisted and it was enacted.
  • The 19th Amendment, which gave women the right to vote, began as a serious movement in the mid-19th century. Congress passed the legislation in July 1919, and ratified it in August 1920. As noted by the National Archives, "Few early supporters lived to see final victory in 1920," but it was enacted.
  • The 26th Amendment, which lowered the voting age to 18 years of age, was debated for thirty years, but took three months and eight days to ratify after being passed by Congress.

Fulton Sheen said, "Patience is power. Patience is not an absence of action; rather it is "timing" it waits on the right time to act, for the right principles and in the right way."

Those who seek to protect the control, power and abuse they have carved out with the current income tax system believe that if they just keep throwing up roadblocks and ignore the FairTax movement, we will eventually join the doubters and give up and go away.

We have a message for them.

Never underestimate our patience as being a lack of action. Never doubt our unwavering principles in our quest for simple and fair taxation for all. Never question that we understand the concept of timing, and we are confident our time will come.
What our opponents fear the most is that the FairTax is the right and the best thing to do for America. Many of them instinctively know the truth of what Victor Hugo said so long ago,  "All the forces in the world are not so powerful as an idea whose time has come."

'Unfair' tax movie to be shown Oct. 14 - News-Sentinel

Tax-reform advocates will sponsor a screening of a film critical of the Internal Revenue Service Oct. 14 in Fort Wayne and 700 theaters nationwide. "Unfair," a 90-minute documentary executive produced by John Sullivan, producer of "2016: Obama's America," will be shown at Regal Cinemas in Coldwater Crossing, starting at 7 p.m.

Documentary Takes Aim at Former IRS Official Lois Lerner - Live Trading News

Perhaps unbeknownst to her, former IRS official Lois Lerner will be making her film debut on 14 October in a documentary where she is 1 of the villains.

The film titled Unfair: Exposing the IRS, and will screen in 674 theaters for 1-night only, courtesy of Fathom Events, a company that brings sports, concerts, speeches and other alternative entertainment to movie screens.
The movie is about alleged abuse at the IRS, the agency responsible for collecting taxes in the US…

The scandal triggered several investigations, with the US Treasury Inspector General for Tax Administration confirming that the IRS did, in fact, subject Tea Party groups and other conservative organizations to far more scrutiny than it did liberal groups. Ms. Lerner dismissed calls for her resignation and was eventually called to testify before a House Oversight Committee…

American Conundrum beginning the 21 Century

Friends and Family,
Here are some issues that you need to ask your liberal friends to explain to you.
The definition of Conundrum is: Something that is Puzzling or Confusing.

Here are six Conundrums of socialism in the United States of America:
1. America is capitalist and greedy - yet half of the population is subsidized.
2. Half of the population is subsidized - yet they think they are victims.
3. They think they are victims - yet their representatives run the government.
4. Their representatives run the government - yet the poor keep getting poorer.
5. The poor keep getting poorer - yet they have things that people in other countries only dream about.
6. They have things that people in other countries only dream about - yet they want America to be more like those other countries.

Think about it! And that, my friends, pretty much sums up the USA in the
21st Century.

Makes you wonder who is doing the math.
These three, short sentences tell you a lot about the direction of our current government and cultural environment:

1. We are advised to NOT judge ALL Muslims by the actions of a few lunatics, but we are encouraged to judge ALL gun owners by the actions of a few lunatics.

Funny how that works. And here's another one worth considering...
2. Seems we constantly hear about how Social Security is going to run out of money. But we never hear about welfare or food stamps running out of money? What's interesting is the first group "worked for" their money, but the second didn't.

Think about it.....and Last but not least:

3. Why are we cutting benefits for our veterans, no pay raises for our military and cutting our army to a level lower than before WWII, but we are not stopping the payments or benefits to illegal aliens.

Am I missing something?
