SCOTUS on LGBT Appeals Court Rulings ~ Not Federal purview to judge. why no dismissals at Appeals level? #MIGOP #tcot #sgp

Federal law does not supersede State law when Federal law/Court Rulings are unconstitutional.

 In the SCOTUS recent Windsor decision of not hearing the several Appeals Court decisions, the Federal Supreme Court stated that they are not hearing those cases, because the federal government has no jurisdiction over moral issues.  This should of it's own undone those Appeals courts that removed the States' Sanctity of Marriage determinations of marriage being of one man and one woman.

Why have we been silent to this fact?  Why have not these Appeals Court decisions been dismissed?

On Tuesday, United States District Judge Juan Pérez-Giménezupheld Puerto Rico’s law defining marriage as the union of a man and a woman. He concluded that the U.S. Constitution does not require the redefinition of marriage.
And it is the Supreme Court’s Windsor decision that Pérez-Giménez highlights as to why states have constitutional authority to make marriage policy:
The Windsor opinion did not create a fundamental right to same gender marriage nor did it establish that state opposite-gender marriage regulations are amenable to federal constitutional challenges. If anything, Windsorstands for the opposite proposition: it reaffirms the States’ authority over marriage, buttressing Baker’s conclusion that marriage is simply not a federal question.
Pérez-Giménez goes on to cite Windsor: “the definition of marriage is the foundation of the State’s broader authority to regulate the subject of domestic relations with respect to the ‘protection of offspring, property interests, and the enforcement of marital responsibilities.’”

 "Do Blacks and Hispanics Lack Family Values? Friends, this is an article I wrote last year, in response to Paul Welday saying that the MIGOP “cannot win without making significant inroads into non-white voting blocs.”

Welday suggested that the way for the MIGOP to do so is to change its position on issues such as abortion and same sex marriage by being silent on these issues, if not permissive. By associating this with outreach to "non-whites", he suggested these groups lack family values. I would go so far as to say that those who are calling for Agema's resignation are saying Evangelical Christians in general lack a proper understanding of American and family values, in light of what they themselves are asserting about Agema and, ultimately, all who support him.

To quote Welday: "If gay people want to formalize their relationships, we should look at this as more an affirmation of our values than an assault on our liberties.”

This is the perspective that is starting to permeate in the MIGOP leadership, starting with Bobby Schotak and, apparently, Gov. Synder. This is the message be spread by Dennis Lennox and Republicans across the nation who are still calling for Dave Agema to resign. What they are really is affirmation of same sex marriage and of ideals that threaten the future of our Judeo Christian values in America. It should be noted that it is the leader of the Pro Same Sex Marriage "Log Cabin Republican" and Lennox who are being quoted in the Detroit News today in condemnation of Dave Agema.

I did not know until today that Terri Lynn Land also has joined the ranks of those have publicly come out against Dave Agema, confirming her surrender to the above stated agenda which seeks affirmation. The only way to vote for someone who has any Nationalist plank in their platform is if the unconstitutional conduct is being used to work our way back to Constitutional Conduct.  If we have something we want to keep that is unconstitutional, we can put it up for a vote of the States' legislatures to keep or not to keep, through the use of Article Five of the Constitution.

Want to keep regulation of something, make it a Constitutional law or stop.  We have regulation of food and have better living through chemical engineering and a company like Monsanto becoming a beast.  It is a State power to control all property within the State, including the use of chemicals.  However, provisions to protect State Sovereignty, such as an opt out clause be put  in all kept regulation by Article Five, that it can be a State power to refuse, making it voluntary compliance.

My Activist path of the 2008 to the 2012 Primary eve in Iowa

When Newt dropped out in 2007, I found myself having to get active and vett candidates. When I ran into Governor Huckabee, it was like he had a recorder in my home repeating everything I had said.

Governor Huckaee would have been President had he not been bulldogged in SC debate. He has the Quest as his own. Then cam Cain, who too has the Quest in his Mission.

All during the past five years, I have spent a lot of time countering the lies about Ron Paul and the mediabot hate for him We must recognize the we are being divided on the right, leaving the Constitutionalists formed regardless of their State affiliation.

Paul has come to the top in a big way this year, being the only Constitutionalist standing in the top tier. Despite the thousands of cuts causing ferocity hazing, his Quest is the Constitution and fiscal repair. A week ago, I came to a pint that I said, done, no more vetting. Constitutionalist Paul has my support.


The Social Conservatives have defined Constitutional conduct as their number one plank. The anti-war crowd on the left are many. Momentum for the Constitutionalist will draw from the right and if it is Paul, he will sink Obama.

Should Paul fail to beat back the Nationalists and those who are not awake yet to it, then you can count on a third party. Sent Sarah a note to ready ready and to seek the Constitutionalist party ticket. Doctor Paul endorsed the Constitutionalist candidate in 2008. This may be the most interesting year of the century and we just got started. If we do well, we could see our future setting new standards in American Prosperity. If we go the wrong way, it will take most of the century to get anywhere and if liberty is involved.

FairTax will provide a GDP of way north of 10% per year for years to come and Constitutional conduct will create such a peace and tranquility, blessings will overflow.


When our Constitution was devised,it was a given that local governance was the norm, from the bottom up. If the local level could not do it, the next level up would. It was not question of convenience, but a matter of principle. Now we rule by decree rather then common law.

Success in an International World

There is a war which is going on within America and the world. It has played out in many of the political skirmishes over recent election cycles. The question of American sovereignty as the world become more interconnected and "closer" together. If one listens to the Neo-Conservative response to this interconnectedness, it would seem that the more trade ties with other countries, the weaker we become. Protectionism is their gameplan. On the other hand, libertarians and progressives explain that without a wide open and subservient (to our partners) trade agenda, we will fall behind the world in the 21st century. I believe that using either of these approaches will be disastrous for our nation...
...Now that I have outlined different paths ideologues wish for us to take, I would like to take a little time to outline a more practical and advantageous approach. First, we should keep in mind that capitalism is a redistribution of wealth that compensates those with goods and services that are sought after and roots out those who are not providing wanted goods and services. Therefore, I am not afraid of trade unions. Nations can join those unions, but the rules of the union should be equivocal for all members, not penalizing richer members at the expense of poorer ones. If the poorer nations offer the goods and services, they will be enriched. The fair compensation of workers should be indexed to the standard of life/cost of living index rather than a one size fits all approach.

Next, the US should embrace international free trade. What we need to do is completely revamp the tax code. I recommend the FairTax. Brazil is looking into the FairTax and we should be afraid. I will have a blog explaining this interesting tax reform idea in detail. What it is in the most basic form is the repealing of Income, Corporate, Payroll, Medicaid, Medicare, and Capital Gains taxes and rolling it into one 23% consumption tax. While 23% seems high, keep in mind that we as consumers pay all of these taxes at the checkout counter already. Economists have calculated that the final price for goods are inflated 22% because companies have to add the taxes down the line anyways. Every time corporations and smaller businesses are further taxed, all they do is roll the cost down to the consumer. Add that 22% embedded tax plus the income taxes, payroll taxes, Medicare, Medicaid taxes and you see that you are being bled. Due to our wild tax system that NO ONE understands not even the IRS itself, corporations move their operations out of the U.S. It isn't as much to do with cheaper labor but our laborious tax structure. We have the second highest corporate tax rate. We have high personal income taxes. We have a 6.5% payroll tax which is matched by the employer which must be paid to the Federal government, that's a 13% tax. As you can see, the tax structure is a burden on rich, poor, and average American people and corporations. With a simple one time 23% consumption tax, which would stimulate investing since that would never be taxed (Capital Gains) until you went to buy something. This is a simple overview, but keep this in mind, 50 corporate leaders were asked if the U.S. Adopted the FairTax, would they move their corporate offices to the U.S.? Their answer? 48 of the 50 said they would absolutely move to the U.S. The other two? They said they would "strongly consider" it. The FairTax was not created by politicians. It was created by economists who wished to create a powerful taxing machine that would lower the tax burden on ALL people, and end the political earmarking done in the current code.

With companies moving back to the U.S. And new businesses moving in, America could be a powerhouse in trade again. We also need to promote solar, wind, water, and other alternative fuels NOT with federal subsidies, but instead staying out of the way. Government regulations need to loosen for new industries. By adding regulations we discourage or downright trample on small entrepreneurs who wish to enter the industry. Heavy taxation and high costs to comply with federal and state regulations not only hurt small entrepreneurs, but is welcomed by bigger businesses who understand that these impediments ensure that only large ventures could even hope to enter the industry, i.e. less competition.

In conclusion, I argue that we should not only embrace a world stage to sell goods, but also become a major player who competes directly with all other nations. With a FairTax, return to strong free market principles, and even including trade unions which help to engender good will with our neighbors without exploiting ourselves to their benefit are the steps we should take to build a positive flow of capital from around the world to America, create jobs in America, strengthen our current businesses, and promote small business development.

We can be American in an international world. In fact, giving up our values would hinder our progress. America became a great power through trade. We believed in free trade. Let's not lose those principles. We should embrace them and revitalize our economy and put it on a solid footing.

SARAH PALIN may be the Republican Party's rock star, but Mike Huckabee can actually play the bass guitar. While campaigning for the presidency last year, he would often whip it out and start jamming. Lexington heard him a few times. He was at least as good as that other former governor of Arkansas, the one who plays the saxophone. And his latest book has more about rock music in it than the title, "A Simple Christmas", might suggest.

As an eight-year-old boy in 1964, he watched the Beatles on the Ed Sullivan Show and immediately wanted to be one of them. He put "electric guitar" on his Christmas list, but his parents picked something cheaper. After two years, he drew up a list with only the guitar on it. Alarmed by the price, his parents urged him to reconsider. No, he said, it's a guitar or nothing. They gave in. "I didn't know until years later…just how much money $99 was to my parents," recalls Mr Huckabee. It took them a year to pay for it. The lesson? Christmas is about sacrifice. Several Christmases later, when he was a penniless father-to-be, he sold his precious guitars (he had two by then) to buy a washing machine.

Political memoirs aim to make money and charm voters. Mrs Palin's recent volume is generating more cash than Mr Huckabee's, but also more controversy: it is packed with score-settling. Mr Huckabee's memoir, by contrast, is disguised as a book of heart-warming Christmas stories. Cynics will call it corny, but it offends no one. In this, it resembles Mr Huckabee's weekly television show on Fox News. Like a conservative Oprah, he interviews nice people about the challenges they have overcome or the good works they are doing. This week's show featured a football coach who cared for his Alzheimer's-stricken wife, musicians who wrote a song for a vegetable-themed children's movie and an appeal to put old toys in shoeboxes and send them to poor children. Asked why his show is not more strident, Mr Huckabee replies that people want to relax at the weekend.

The race for the Republican nomination in 2012 is wide open. Mrs Palin hogs the headlines, but half the country hates her, so she cannot plausibly win a general election. Mr Huckabee's views on faith, family, abortion, gays and guns are almost indistinguishable from hers, yet hardly anyone hates him. He seems so reasonable: soft-spoken and gently humorous. "Lord give me patience," he says, "right now!" He describes something improbable as being "as likely as someone going up to Chuck Norris and taking away his chest hair". He does not sound intolerant. Of the tut-tutting about a certain golfer, he says: "Don't worry about what's happening behind the doors of Tiger's house. Focus on what's happening behind the doors at your house."...full article

The Manhattan Declaration~ What you think?

I think:
This declaration, "The Manhattan Declaration" is but one plank of our battle with the Federal Government.  The abuse spoken to by this Declaration is found in near all actions of the Federal Government.  We are declaring Civil War on the GOP and our weapon of choice, the ballot.  The deadline on getting Constitution believing candidates is already past for Illinois.[Early Battle Ground primary dates]  Many are  coming up.  We need to be sure someone of this Federalist character is in place, on the ballot for the primary.  Otherwise, all is lost at the gate.

This alleged suspect was once walking the streets due to the character of America's Law of Grace and mercy. Better to have a Man of conviction who is a cautious leader then one who throws away the key. Gov. Huckabee, as Governor's of any State, did his job well. This unfortunate incident has many people saying "if only I had done this".

We live in a judicial system that is ran by politically correct feelings, that the line between circumstantial facts and direct evidence is so blurred, the Judge reads the Law to the Jurists and it seems to be like glass as the words fall to the floor, much like the truth of Jury Nullification.

The number of Souls who repented and have gone on to be respectable citizens from Governor Huckabee's pardon does not justify the loss of life from one who disrespects their Mercy. But to not have pardons for your sins, leaves your liberty in a very difficult position. The Old Testament with it's eye for an eye had a system of redemption. Not so sure about the Islam's Shariah Law for it to is an eye for an eye.

Don't opportunity do this often but this circumstance demands this:

And, behold a certain lawyer stood up, and tempted him, saying, Master, what shall I do to inherit eternal life? He said unto him, what is written in the law? how readest thou? Health Care Fairy Tale

On Wednesday, President Obama held a news conference, which was designed to enlist public support for his universal healthcare plan. I think it is pretty safe to say that the President's remarks created more questions than he answered.

There isn't any question that there is a disconnect between the President and the American people on the issue of health care. Most Americans do not want government controlled health care. They do want lower costs.

Like most Americans, I find myself asking again and again, why the rush to adopt a national health care plan that will consume 1/6 of our federal budget? Isn't this an important issue that we should take our time on, debate fully all of the proposals being floated, and make sure that everyone, including our legislators, has a chance to read the bill?

The Obama Administration continues to say that the issue has been debated for years. That may or may not be true, but what is true is that the bills being proposed on Capitol Hill have not been debated!!! In fact, no one seems to know what is in them

The President cites as a reason for quick action, rising costs of health care. Yet even the Congressional Budget Office says the plans being offered will not decrease costs, and in fact, will increase them. Seems like a good time to get our figures straight before we try to pass any legislation...

Time is our friend here.  Any attempt to push Health Care through by the House rules will be an affront to We the People.
Constitutionally, the control of Healthcare by the Federal Government is limited.  It cannot become as Medicare is.
The Feds can however unify the States by providing the framework for private of State system to impede the undue costs within Health care.  They can end lawsuits; make mandatory HSA/IRA for anyone under age of 50 (eventually replacing Social Security);
Socially, there is not any permission by the Constitution to allow Federal Health Care.  However, States can delve into it if their Constitution allows it.  It would behoove us to center on States converting their Health care for the disadvantaged to the HSA/IRA plans.
Details are what needs cleaned up.  The placing records online can be an invasion of privacy, but so is today's world.  Make data private property and streamline healthcare, stopping duplicate services and providing greater care.
We need to divest ourselves of Federal Social programs, not add to them.  The first settlers tried the commune approach of equal distribution and they nearly starved to death due to slackers not providing their fair share.  Don't end the American dream by doing the same here, ending the ability to get ahead.

Team Huck ... What Does It Look Like?

I got an e-mail from a Republican Party committee person who expressed interest in what we are doing at Team Huck. He wondered what that would look like. Here was my answer:

I can't really tell you what our efforts will look like in the months ahead. We want to see conservative candidates elected at all levels. And we want to get people involved in the process ... to make them feel like their opinions matter. We want them to feel like this is their government. Too many people feel disenfranchised right now and that makes your job and mine much harder. We want to change that, although I hesitate to even use the word change.

We are looking for leaders in every county who will help recruit people and raise funds so that we are ready to hit the ground running for the 2010 elections. We are looking for candidates Huck PAC can endorse and promote. Our teams will help with local rallies, with literature drops, with canvasing and the many other tasks involved in campaigns. Last year our volunteers made thousands of calls in support of conservative candidates through online phone banks.

Today Team Huck members were responsible for sending thousands of Red Envelopes to the White House. Next week they will send many more thousands of tea bags to Congress. They have taken part in and will take part in Tea Parties all over the country and are even planning a campaign in July. The enthusiasm and energy that have gone into these events will also go to supporting candidates. Just give us good candidates and we will give them willing volunteers. There is much we can do, but first we need to get everyone involved in the process. I hope this answers your question.

    It's time for a true conservative party that stands on our founding Christian principles with no PC or appologies. I'm not sure the current republican party fills that bill.

One fact is for sure that stands out from the campaign and that is
 
[b]"I stand for Main Street, not Wall Street!"[/b]  The entire platform of your campaign Governor Huckabee is exactly where the American people will head when they are finally woke up as these tea parties, 9/12 indicate. 
 
Fair Tax Please!!!  If there is one factor that the GOP must get their Platomic infected minds around is that the Fair Tax plan is a must for the GOP to survive.  The tax structure now in place is big government pure and simple.  It is weakening this Nation, for what ever reason: to provide for those tin foil one world crowd shadow people in Washington to destroy the dollar; or because they are so self centered they cannot see that after the free trade policy was implemented, our tax structure became an excise tax on American business, thus the real reason we lost all those manufacturing jobs. If it was planned to share the wealth of American enterprise to those around the world , it worked. 
 
Now is the time to end this charade and bring about fair free trade, and liberty and freedom the individual worker.  It is time for blue collar conservative America to dominate the GOP and the Democrats! 
 
The Nationalism jig is up and over with.  It is  [b]time for States to take back their sovereignty[/b]
 
Make sure the candidates we support are on board for the Fair Tax, the Constitution as Written and for inalienable rights and Morals set forth by GOD!!!

A note from me,,,,,

As you read the next post, it will not take you long to see that my blog fits the profile that the government is now saying is terrorist actions.
This is hitting close to home for me and many people I know and care for. We all have Ron Paul bumper stickers, along with many other stickers. We own books and movies that inform Americans about our history and tell truths about events that have occurred in our country.
We carry a copy of the Constitution and are happy to share these with others. (how does that sound like a terrorist?)
Speak out about this to others, read the links in the next post. This could be in your state next. Missouri isn't too far from home.
and last, but far from least--Please everyone unite in Prayer. We must all seek Gods Wisdom in how to protect our families, and how to preserve our freedoms,,,,if you won't do it for yourself, please do it for our children.

We have your Back. This has hit widely and it is opening a lot of eyes to why we need to git to those tea parties. They are our future! The Main Stream old media ignores the numbers. On 03/23, Orlando two grassroots moms, put on a Tea party in support of the Fight against the Tyranny of the Federal Government. The largest gathering ever in Orlando showed up!!!

The Constitutional Right has been attacked here as you have clearly made historical document of the oppression coming from Central Governments, a State, a Country by the U. S. Constitutions decree!

Excuse me for the error, the U. S. of America are no longer that any more. Today the Senate passed the American Volunteer Act that provides for 25% of the population of America to be employed, in his Civilian Army. Imagine an ACORN the size of THAT!!! Now it is the D. S. of America. Domain

The last date of needed Repentance by the Federal Government in the Surrender to the Constitution is 9/12. Glenn Back has birthed this date. We don't need to go there. Let us but agree to set up a council of 50 State Elders to provide for a plan of recovery from where we have strayed. Set up any social program separate and voluntary under these Elders, elected by the people as the Administrator of General Welfare programs, keeping the programs balanced on Constitutional.

Doctor Ron Paul has been the sage of the Century. His passion for the Truth in this Nation's Conduct made everyone feel guilty for being so ignorant. We have been snookered as a people. Reminds one of the people back in the Old Soviet Empire having one source of news, Provda and the people in that Nation believed it to be true, whether they wanted to or not. It became a habit.

Now that all is so clear it is time America say to say to Doctor Paul, "You Are Right!"

However, Ron Paul has a political issue with Taxes and has not supported the Fair Tax Plan. I know he would if he opened to it. If not, please come forward and debate it. The Doctor would very much agree to this. Starting on July 4th, 2009, all the taxes in your paycheck are officially over, and considered illegal for 6 months. Then set in place the Fair Tax Plan on January 1st, 2010. That way, we can keep the paycheck as gross, 22% increase in average Salary. Just ask Mike Huckabee about it.

Why are we not holding a summit of Conservative Leaders in both the Government and the private sector. This is America, in liberty and justice for under the Constitution, the Greatest Document ever created to bring FREEDOM!!!
